Service terms

Introduction

FlexShark is an independent automation and management tool. By creating an account, linking an Amazon Flex account, starting the bot, or otherwise using FlexShark, you confirm that you have read, understood, and accepted these Terms and Conditions.

User responsibility

You are solely responsible for deciding whether FlexShark is appropriate for your use. You are responsible for your Amazon Flex account, your configured filters and schedules, your use of automation, and all results or consequences that follow from using the service.

Amazon Flex and third-party platform risk

FlexShark is not affiliated with, endorsed by, or controlled by Amazon or Amazon Flex. Amazon may treat third-party applications, bots, scripts, tappers, or other automation as a breach of its own terms. Amazon may send warnings, restrict features, suspend access, deactivate an account, terminate participation, or take other action. You accept this risk entirely.

Account notices and deactivation

If you receive any email, notice, warning, preliminary deactivation notice, suspension notice, account review, appeal request, or similar action from Amazon or any other platform because of automation or suspected automation, you remain solely responsible for responding to that platform and for any account, financial, operational, or legal consequences. FlexShark cannot guarantee that any notice can be avoided, reversed, or successfully appealed.

Compliance with third-party terms

You are responsible for reviewing and complying with Amazon Flex terms, policies, program rules, local laws, tax obligations, insurance obligations, and any other requirements that apply to your delivery work. FlexShark does not provide legal, tax, employment, insurance, or platform-compliance advice.

User-controlled automation

FlexShark acts based on the settings, permissions, account connection, filters, schedule windows, start switch, and other preferences configured for your account. You are responsible for checking those settings before enabling automation and for stopping use if you no longer want FlexShark to search, accept, forfeit, or otherwise interact with available features.

No guarantees

FlexShark is provided on an as-is and as-available basis. We do not guarantee block availability, earnings, acceptance success, uninterrupted access, compatibility with Amazon systems, avoidance of platform warnings, financial/non-financial or any other kind of loss, continued account standing, or any particular result from using the service.

Payment

FlexShark uses Stripe as its payment processor. Stripe terms and privacy policies apply to payment processing. You are responsible for keeping payment information current and for paying valid fees generated under the pricing terms shown on the Pricing page.

Refunds and billing questions

Refer to Pricing for billing and refund-related support details. Refund decisions are handled according to the published pricing and support process and do not transfer responsibility for platform-account outcomes to FlexShark.

Prohibited uses

You may not use FlexShark for illegal activity, rights infringement, abusive activity, malicious code, account sharing that violates applicable rules, attempts to bypass security controls, or any use that damages FlexShark, other users, third-party platforms, or service providers.

Limitation of liability

FlexShark, its owners, operators, affiliates, contractors, and service providers are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, lost earnings, lost opportunities, lost blocks, account warnings, suspensions, deactivations, termination of Amazon Flex access, or third-party platform decisions arising from or related to your use of FlexShark. Where liability cannot be excluded, our aggregate liability is limited to the fees you paid to FlexShark in the one month before the event giving rise to the claim.

Indemnification

You agree to defend, indemnify, and hold harmless FlexShark, its owners, operators, affiliates, contractors, and service providers from claims, losses, damages, liabilities, penalties, costs, and expenses arising from your use or misuse of FlexShark, your settings, your Amazon Flex account activity, your breach of these terms, or any allegation that your use of automation breached a third-party platform rule or law.

Consumer law savings clause

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, statutory right, or liability that cannot lawfully be excluded, restricted, or modified.

Termination

We may suspend or terminate your use of FlexShark at any time, including if we believe your use creates risk for the service, other users, third-party platforms, payment processing, infrastructure, or legal compliance.

Changes to Terms and Conditions

We may modify or update these Terms and Conditions at any time. Continued use of the website or service means you accept the updated terms.

Entire agreement

These Terms and Conditions form the entire agreement between you and FlexShark regarding website and service use, except for any additional written terms that expressly apply.
